Union representation: bill before the Chamber (Newsletter Norme & Tributi n. 144 Camera di Commercio Italo-Germanica – Vittorio De Luca, Elena Cannone)

Bill C. 788 was submitted to the Chamber of Deputies in July 2018. Its aim is to define procedures to measure the actual representation of worker unions (“OOSS”) and identify parameters to measure employer organisation representation. The former is based on the average of membership and electoral figures. Membership is calculated by INPS from notices received from employers, for payment authorisation for union member dues and sent to CNEL by 31 January the following year. Measurement of the electoral figure is based on the results obtained from unions in representative (RSU) elections and sent to CNEL. The level of union representation must not be less than 5%, considering the average between the membership and electoral figures. Additional parameters to establish representation is permitted for agreements signed by unions that are comparatively more representative at national level. These agreements, if signed within 1 year from enactment of the law, can set parameters for identifying the representation of employer unions. The proposal is currently being examined by the Chamber’s XI Labour Commission.
