Court of Cassation, with judgment no. 5179 filed on March 5, stated that an employee who sent his legal attorney documentation concerning confidential company information may not be dismissed. The judgment specified the difference between disclosing news regarding the company and sending the latter to a lawyer, in the light of possible litigation, whether or not litigation is commenced. In this case, according to the Court, the information will only be known by the employee and the lawyer, who is bound by client-lawyer confidentiality obligations.
