FIXED-TERM CONTRACTS WITH INDEMNITY

After the coming in force of the so called “Collegato Lavoro”, Courts stated on compensation issue in case of fixed-term contract conversion into an open-ended one. Judges considered that the compensation indemnity included between 2,5 and 12 monthly wages set by law has to be considered as fully-comprehensive, so that – in case of contract conversion – employee is entitled to this indemnity only and not to damage compensation as well. Moreover, most of Courts stated that the new rule applies to “all pending proceedings” and also to appeal proceedings.
